Your Agreement

This website is owned and operated by PT. Nutrifood Indonesia ("Nutrifood") and is made available to you for informational purposes. By accessing or using this Site, you agree to these Terms of Use and to our Privacy Policy. If you do not agree to the Terms of Use and Privacy Policy, you may not use this Site.

Your Use of the Site

Unless otherwise specified, the Site is provided for your personal and noncommercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Site. You may display and electronically copy, download and print hard copy portions of the material contained on the Site for your own noncommercial use, provided that you do not modify or delete any copyright, trademark or other proprietary notices. Indemnification

Links to Other Sites

This Site may provide access to other World Wide websites. Nutrifood does not control these sites, and you access them solely at your own risk. Nutrifood also does not endorse or approve any products or information offered at sites you reach through this Site. Check the Uniform Resource Locator (URL) address provided in your WWW browser to determine if you are still in this Nutrifood Site or have moved to another website.

Jurisdiction

Nutrifood controls and operates this Site from the company's headquarters in Jakarta, Indonesia. We in no way warrant or imply that the materials on the Site are appropriate for use outside of the Indonesia. If you use the Site from a location outside of the Indonesia, you are solely responsible for compliance with any applicable local laws. You may not use or export the materials on the Site in violation of Indonesian export laws and regulations. Any claim relating to the website or your use of it shall be governed by the internal substantive laws of the Indonesia, without regard to its conflict of laws provisions, and you agree that jurisdiction and venue in any legal proceeding directly or indirectly arising out of or relating to this Site shall be in clerk office of East Jakarta District Court.

Nutrifood is entitled to terminate all or any portion of this Site at any time, without notice to you. Termination of this Agreement

This agreement is effective until terminated by either party. You may terminate the agreement at any time, by destroying all materials obtained from this Site, along with all related documentation and all copies and installations. Nutrifood may terminate this agreement at any time and without notice to you if, in its sole judgment, you breach any term or condition of this agreement. Upon termination, you must destroy all materials.

Language

This Agreement is made in bilingual, in English and Indonesia. Shall there be any dispute arisen to interpret them, the Indonesian text shall prevail.

Miscellaneous

If any provision of this agreement is unlawful, void or unenforceable, the remaining provisions of the agreement will remain in place. This is the entire agreement between you and Nutrifood regarding all aspects of your use of this Site.

This website is owned and operated by Nutrifood. Here at Nutrifood, we recognize that many visitors to our site are concerned about the information they provide to us, and how we treat that information. So we've developed this Privacy Policy to address those concerns. We may update this Policy from time to time, so please check in occasionally.

Types of Information We Collect

At our site, we collect both personally-identifiable information and aggregate information.

Personally-identifiable information relates to an individual consumer - e.g., name, address, telephone number, e-mail address, credit card number, etc. We only collect personally-identifiable information from individuals who provide it to us voluntarily and knowingly, such as by registering at our site, or by providing name and address information and requesting follow-up contacts from us. Dengan mengakses atau menggunakan Situs ini, saudara setuju dengan Syarat Penggunaan dan Kebijakan Privasi kami. Saudara hanya boleh menggunakan Situs ini jika saudara setuju dengan Syarat Penggunaan dan Kebijakan Privasi tersebut.

Penggunaan situs

Kecuali ditetapkan secara lain, Situs disediakan untuk digunakan secara pribadi dan bukan untuk tujuan komersial. SITUS DAN MATERIAL, INFORMASI, JASA, DAN PRODUK DALAM SITUS INI, TERMASUK, TANPA TERBATAS PADA, WACANA, GRAFIK DAN LINKS, DIBERIKAN “SECARA APA ADANYA” DAN TANPA JAMINAN APAPUN, BAIK TERSURAT MAUPUN TERSIRAT.SEPANJANG DAPAT DIIJINKAN SESUAI DENGAN HUKUM YANG BERLAKU, NUTRIFOOD MENYANGKAL SEMUA JAMINAN, BAIK TERSURAT MAUPUN TERSIRAT, TERMASUK NAMUN TIDAK TERBATAS PADA JAMINAN TERSIRAT DARI KEMUNGKINAN DAPAT DIPERJUALBELIKAN DAN KESESUAIAN UNTUK TUJUAN TERTENTU, TIDAK MELAKUKAN PELANGGARAN, BEBAS DARI VIRUS KOMPUTER, DAN JAMINAN YANG TIMBUL SELAMA BERLANGSUNGNYA KESEPAKATAN ATAU SELAMA PELAKSANAAN PEKERJAAN. NUTRIFOOD TIDAK MENYATAKAN ATAU MENJAMIN BAHWA FUNGSI YANG TERDAPAT DALAM SITUS AKAN BEBAS GANGGUAN ATAU BAHWA BEBAS KESALAHAN, BAHWA CACAT TERSEBUT AKAN DIPERBAIKI, ATAU BAHWA SITUS ATAU SERVER YANG MENYEDIAKAN SITUS TERSEBUT BEBAS DARI VIRUS ATAU KOMPONEN BERBAHAYA LAIN. NUTRIFOOD TIDAK MEMBERIKAN JAMINAN ATAU PERNYATAAN SEPUTAR PENGGUNAAN MATERIAL DALAM SITUS INI DALAM HAL KELENGKAPAN, KEBENARAN, AKURASI, KECUKUPAN MATERIAL DI ATAS. SAUDARA (DAN BUKAN NUTRIFOOD) HARUS MENANGGUNG SEMUA BIAYA PENSERVISAN, PERBAIKAN ATAU PEMBETULAN.

Pembatasan pertanggung jawaban

BAGAIMANAPUN JUGA NUTRIFOOD TIDAK AKAN BERTANGGUNG JAWAB ATAS SEMUA KERUSAKAN LANGSUNG, TIDAK LANGSUNG, KHUSUS, YANG BERSIFAT HUKUMAN, TIDAK DISENGAJA, SEBAGAI PERINGATAN ATAU SEBAGAI AKIBAT YANG DITIMBULKAN ATAU SEGALA KERUSAKAN APA PUN, BAHKAN JIKA NUTRIFOOD TELAH DIBERITAHU SEBELUMNYA TENTANG KEMUNGKINAN ADANYA KERUSAKAN TERSEBUT, BAIK DALAM TINDAKAN BERDASARKAN KONTRAK, KELALAIAN, ATAU TEORI LAIN, YANG TIMBUL SEBAGAI AKIBAT DARI ATAU BERKAITAN DENGAN PENGGUNAAN, KETIDAK MAMPUAN UNTUK MENGGUNAKAN, ATAU KINERJA INFORMASI, LAYANAN, PRODUK DAN MATERIAL TERSEBUT YANG TERSEDIA DARI SITUS INI. PEMBATASAN INI AKAN BERLAKU MESKIPUN TIDAK TERPENUHINYA TUJUAN UTAMA ATAS SEGALA TINDAKAN PERBAIKAN TERBATAS. Pemberian ganti rugi

Saudara setuju untuk memberi ganti rugi, membela, dan membebaskan Nutrifood, para pejabat, direksi, karyawan, wakil, pemberi lisensi dan para pemasoknya dari dan terhadap semua kerugian, ongkos, kerusakan dan biaya, termasuk biaya wajar pengacara dan pengadilan, akibat dari setiap pelanggaran syarat dan ketentuan ini atau segala kegiatan yang terkait dengan akun (account) Internet (termasuk, namun tidak terbatas pada, tindakan kelalaian atau kesalahan), oleh saudara atau siapa pun yang masuk ke Situs tersebut dengan menggunakan akun internet saudara.

Keterkaitan (Links) dengan Situs Lain

Situs ini dapat memberikan akses ke World Wide website. Nutrifood tidak memiliki situs-situs ini, dan saudara mengakses situs-situs tersebut atas tanggungan saudara sendiri. Nutrifood juga tidak membenarkan atau menyetujui setiap produk atau informasi yang ditawarkan di dalam situs-situs yang saudara akses melalui Situs ini. Periksa alamat Uniform Resource Locator (URL) yang diberikan di browser WWW saudara untuk menentukan apakah saudara masih di Situs Nutrifood atau telah pindah ke website lain.

Nutrifood memiliki dan mengoperasikan Situs ini dari kantor pusat perusahaan di Jakarta, Indonesia. Setiap klaim yang terkait dengan website atau penggunaannya oleh saudara akan diatur oleh hukum positif Indonesia, tanpa menghiraukan pertentangannya dengan ketentuan hukum, dan saudara setuju bahwa yurisdiksi dan tempat dalam setiap proses hukum langsung dan tidak langsung yang timbul dari atau berkaitan dengan Situs ini akan dilangsungkan di kantor panitera Pengadilan Negeri Jakarta Timur.

Perubahan Website dan Ketentuan Penggunaan

Dengan memberikan bahan dalam Situs ini, Nutrifood tidak berjanji bahwa bahan tersebut akan selalu ada di situs tersebut. Nutrifood berhak untuk menutup semua atau setiap bagian dari Situs ini pada setiap saat, tanpa pemberitahuan sebelumnya. Nutrifood juga berhak untuk mengubah syarat, ketentuan dan pernyataan yang menjadi dasar dapat digunakannya Situs ini, dan penggunaan Situs tersebut oleh saudara dengan mengikuti perubahan tersebut akan dianggap sebagai persetujuan saudara terhadap perubahan Ketentuan Penggunaan. Saudara setuju untuk secara berkala melihat Ketentuan Penggunaan untuk mengetahui apakah ketentuan tersebut telah diubah.

Pengakhiran Perjanjian ini

Perjanjian ini akan berlaku sampai diakhiri oleh salah satu pihak. Saudara dapat mengakhiri perjanjian ini pada setiap saat, dengan menghancurkan semua material yang diperoleh dari Situs ini, beserta dengan semua dokumentasi terkait dan semua salinan dan instalasi. Nutrifood dapat mengakhiri perjanjian ini pada setiap saat dan tanpa pemberitahuan sebelumnya jika, saudara dinilai telah melanggar salah satu syarat atau ketentuan perjanjian ini. Pada saat perjanjian ini diakhiri, saudara harus menghancurkan semua material.

Bahasa

Perjanjian ini dibuat dalam dua bahasa, Indonesia dan Inggris. Bila ada perbedaan interpretasi diantara keduanya, maka teks bahasa Indonesia yang akan berlaku. Lain-lain

Jika salah satu dari ketentuan perjanjian ini tidak sah, tidak berlaku atau tidak dapat diberlakukan, maka ketentuan selebihnya dari perjanjian ini akan tetap berlaku. Perjanjian ini merupakan keseluruhan perjanjian antara saudara dan Nutrifood berkenaan dengan semua aspek penggunaan Situs ini oleh saudara.

Nutrifood Kebijakan Privasi

Website ini milik dan dioperasikan oleh Nutrifood. Di sini di Nutrifood, kami mengetahui bahwa banyak pengunjung situs kami sangat peduli dengan informasi yang mereka berikan kepada kami, dan bagaimana kami memperlakukan informasi tersebut. Oleh karena itu, kami telah menyusun Kebijakan Privasi untuk menangani kepedulian tersebut. Kami dapat memperbaharui Kebijakan ini dari waktu ke waktu, jadi periksalah selalu terlebih dahulu kebijakan privasi kami tersebut.

Jenis Informasi yang kami simpan

Di situs kami, kami menyimpan informasi untuk akses pribadi dan informasi umum. Informasi untuk akses pribadi terkait dengan pelanggan perseorangan, misalnya, nama, alamat, nomor telepon, alamat surat elektronik, nomor kartu kredit, dan sebagainya. Kami hanya menyimpan informasi untuk akses pribadi dari siapa pun yang memberikan informasi kepada kami atas dasar kehendak dan keinginannya sendiri, seperti dengan mendaftar di situs kami, atau dengan memberikan informasi nama dan alamat dan meminta tindak lanjut dari kami. Kami tidak mensyaratkan saudara untuk mendaftar atau memberikan informasi ini kepada kami agar dapat melihat situs kami atau mengakses ke dalam isinya.

Informasi umum terkait dengan hal-hal seperti berapa banyak pelanggan yang mengunjungi stus, halaman mana yang mereka akses, informasi apa yang mereka unduh (download), jenis web browser dan sistem operasi yang saudara gunakan, nama Penyedia Jasa Layanan Internet saudara, dan sebagainya. Informasi tentang kapan saudara mengunjungi situs kami akan secara otomatis kami simpan dan gabungkan dengan informasi sejenis yang tersimpan tentang semua pengunjung lain. Dengan menyimpan informasi ini, kami dapat mempelajari bagaimana menyesuaikan website kami dengan para pengunjung situs tersebut.

Bagaimana Informasi disimpan

Sebagaimana telah kami sebutkan di atas, informasi untuk akses pribadi disimpan dari saudara secara langsung dan dengan sepengetahuan saudara. Oleh karena itu, pada saat saudara mendaftar di situs tersebut, kami menyimpan informasi yang saudara berikan. Pada saat saudara mengikuti suatu program promosi, kami menyimpan informasi yang saudara perlukan untuk berperanserta dan agar kami dapat memenuhi kewajiban kami kepada saudara. Pada saat saudara mengirim surat elektronik kepada kami, kami akan menyimpan alamat surat elektronik yang saudara berikan, sehingga kami dapat membalas surat elektronik saudara.

Kami juga menyimpan informasi umum, non-pribadi secara terus menerus pada saat saudara masuk ke website kami. Penyimpanan informasi non-pribadi ini dilakukan baik melalui tekhnologi “cookie” atau dengan “web beacons” (juga disebut “single-pixel gifs’) sebagaimana dijelaskan di bawah ini.

Cookies

Seperti kebanyakan perusahaan, kami terkadang menggunakan tekhnologi “cookie” website kami. Cookies adalah bagian informasi yang diletakkan suatu website ke hard drive persorangan untuk tujuan menyimpan catatan. Teknologi tersebut akan menambah pengalaman online saudara dengan menyimpan rujukan saudara pada saat saudara mengunjungi situs tertentu. Kami benar-benar menggunakan cookie untuk membantu kami mengidentifikasi karakteristik situs dan komposisi yang sesuai dengan saudara, sehingga kami dapat melakukan pengembangan darinya.

Bagian “help” pada toolbar di kebanyakan browser akan memberitahu saudara tentang bagaimana untuk mencegah browser saudara menerima cookie baru, atau bagaimana cara untuk meminta browser memberitahu saudara pada saat saudara menerima cookie baru, atau bagaimana menonaktifkan cookies seluruhnya. Ingatlah, walau bagaimanapun juga cookie tersebut memungkinkan saudara untuk memanfaatkan semua karakteristik website terbaru Nutrifood dan kami merekomendasikan agar saudara membiarkannya tetap aktif.

Web Beacons

Web beacons adalah instrumentasi Internet yang membantu kami untuk menentukan, misalnya, apakah suatu halaman telah dilihat. Pada saat saudara meminta kami untuk mengirim informasi promosi atau newsletter, kami mungkin akan menggunakan web beacons untuk menentukan ada berapa banyak dari surat elektronik yang kami kirim yang benar-benar dibuka. Pada umumnya, setiap gambar elektronik yang dilihat sebagai bagian dari web page, termasuk iklan spanduk, dapat berfungsi sebagai web beacons.

Jaringan Iklan Pihak ketiga yang memasukkan iklan ke dalam website Nutrifood dapat menggunakan cookies dan/atau web beacons di iklan mereka. Nutrifood tidak memiliki kontrol terhadap cookies dan/atau web beacons pihak ketiga ini dan tidak memiliki akses ke informasi apa pun yang mereka simpan atas nama pihak ketiga. Selain itu, Nutrifood dapat menggunakan cookies dan/atau web beacons pada saat Nutrifood beriklan di website perusahaan lain. Setiap informasi yang kami simpan dengan cara ini diatur oleh Kebijakan Privasi ini.

Kontes dan Undian

Kadangkala Situs kami menyertakan pemberitahuan promosi yang kami lakukan, dan dalam beberapa hal kami dapat mengijinkan saudara untuk masuk secara elektronik. Jika demikian, kami akan menggunakan informasi yang saudara berikan untuk tujuan pelaksanaan promosi (misalnya, menghubungi saudara jika saudara menjadi pemenang). Saudara setuju untuk mengijinkan kami menyimpannya dan menggunakannya untuk menghubungi saudara kembali.

Daftar Isian dan Survei

Pada setiap saat kami dapat meminta para pengunjung untuk melengkapi survei dan jajak pendapat tentang sikap dan keinginan mereka. Survei membantu kami untuk memahami keperluan saudara. Jika jawaban contoh untuk survei dimasukkan ke dalam situs website tersebut, maka tidak ada informasi untuk akses pribadi yang akan dimasukkan. Jika saudara turut serta dalam salah satu dari survei kami, kami dapat memastikan saudara bahwa kami tidak menyimpan setiap informasi untuk akses pribadi tentang saudara dari survei tersebut di database kami.

Bagaimana Kami Menggunakan Informasi untuk akses pribadi Saudara

Jika saudara setuju dengan tindak lanjut oleh kami atau saudara ingin agar terdaftar di milis (mailing list) kami pada saat saudara mendaftar, kami dapat menghubungi saudara dari waktu ke waktu. Misalnya, kami dapat mengirimkan kepada saudara material pemasaran atau promosi; kami dapat menanggapi saran atau permintaan informasi saudara; atau kami dapat menghubungi saudara jika diperlukan selama berlangsungnya pemrosesan produk atau jasa yang saudara minta melalui website kami.

Pada bagian surat elektronik dari situs kami, kami meminta beberapa informasi untuk akses pribadi, termasuk namun tidak terbatas pada, seperti nama dan/atau nomor telepon saudara. Kami hanya menggunakan informasi ini jika kami perlu untuk menghubungi saudara secara langsung karena upaya kami untuk menghubungi saudara melalui surat elektronik tidak berhasil.

Kami juga menggunakan informasi untuk akses pribadi tentang saudara untuk meningkatkan upaya pemasaran dan promosi kami; untuk secara statistik menganalisa kegunaan website; dan untuk menambah karakteristik dan isi website kami. Kami tidak menyimpan informasi untuk akses pribadi secara otomatis, namun kami dapat menggabungkan informasi non-pribadi yang disimpan secara otomatis (melalui cookies) dengan informasi untuk akses pribadi yang sebelumnya telah saudara serahkan.

Tujuan utama Nutrifood menyimpan informasi untuk akses pribadi adalah untuk memberikan saudara pengalaman berarti dan telah disesuaikan pada saat saudara menggunakan website dan iklan spanduk interaktif kami.

Pihak Ketiga Yang Memberikan Layanan Dukungan kepada Nutrifood

Selama berlangsungnya kegiatan usaha, kami juga melibatkan perusahaan dan perseorangan lain untuk melakukan beragam tugas atas nama kami. Misalnya, kami melibatkan agen perwakilan untuk membantu mengelola promosi pelanggan, menganalisis data, memenuhi pesanan yang saudara lakukan, dan memberikan layanan pelanggan. Wakil-wakil ini memiliki akses ke informasi untuk akses pribadi jika diperlukan untuk melakukan tugas mereka untuk Nutrifood; namun, mereka dilarang untuk menggunakan informasi untuk akses pribadi tersebut untuk tujuan lain dan mereka diminta untuk menjaga kerahasiaan informasi tersebut.

Pembagian dan Pengiriman Data

Kami tidak menjual, mengirim, atau mengungkapkan informasi data pribadi yang kami simpan di website kami kepada pihak ketiga tanpa persetujuan sebelumnya dari saudara. Hanya ada dua perkecualian atas aturan ini: (1) Kami akan mengungkapkan informasi jika kami yakin bahwa pengungkapan data tersebut diperlukan untuk mencegah tindak pidana atau kerugian pada diri kami atau pihak ketiga; dan (2) Kami mengungkapkan informasi kepada pihak ketiga yang memberikan layanan dukungan kepada kami, sebagaimana telah dijelaskan di atas.

Adakalanya ketika kami membagi informasi umum tentang para pengunjung kami (misalnya, persentase pengunjung perempuan dan laki-laki di website kami) dengan para pemasang iklan, para mitra usaha, sponsor, dan pihak ketiga lain dalam upaya untuk menyesuaikan atau menambah isi dan iklan situs kami untuk para pengguna kami. Kami juga dapat mengumpulkan data dari file web log (seperti web browser saudara, sistem operasi, halaman yang dikunjungi, dan sebagainya) untuk mengetahui bagaimana para pengguna menelusuri situs tersebut dan karakteristik apa yang paling diminati.

Hubungan (Link) dengan Situs Lain

Nutrifood berupaya semaksimal mungkin untuk memastikan agar setiap penghubungan di website kami akan mengirim saudara ke tempat yang berguna di Internet. Namun, website dan alamat berubah begitu cepat, dan Nutrifood tidak dapat menjamin muatan dari setiap situs yang penghubungannya disediakan oleh kami. Selain itu, website lain memiliki kebijakan privasi sendiri. Saudara harus selalu melihat kebijakan privasi dari situs tertentu yang saudara kunjungi untuk mengetahui hak saudara.

Pilihan dan Pengawasan

Saudara memegang kendali penuh atas informasi untuk akses pribadi yang saudara berikan kepada kami di situs kami. Misalnya, saudara dapat selalu mengubah preferensi saudara untuk kontak follow-up hanya dengan mengirim surat elektronik kepada Tim online. Atau, jika saudara ingin, saudara dapat membatalkan pendaftaran saudara seluruhnya dan kami akan segera menghapus informasi untuk akses pribadi dari database kami. Kirimlah Surat elektronik kepada kami di alamat yang terdapat dalam kontak jika saudara ingin melakukan langkah ini.

Catatan Penting untuk Anak

Sebelum memberikan nama, alamat, alamat surat elektronik saudara atau informasi untuk akses pribadi lain kepada siapa pun di Internet, mintalah ijin kepada orang tua saudara terlebih dahulu.

Pemutakhiran Pemberitahuan Privasi ini

Kami dapat mengubah atau memutakhirkan Pemberitahuan Privasi ini pada setiap saat dan tanpa pemberitahuan sebelumnya. Periksa kembali dari waktu ke waktu agar saudara dapat mengetahui setiap perubahan atau pemutakhiran terhadap pemberitahuan tersebut. Kami akan menyebutkan tanggal berlaku pemberitahuan tersebut pada halaman pertama dari pemberitahuan tersebut.

Bahasa

Perjanjian ini dibuat dalam dua bahasa, Indonesia dan Inggris. Bila ada perbedaan interpretasi diantara keduanya, maka teks bahasa Indonesia yang akan berlaku.
